1.2 Motorsport Dreams operates a motorsport-focused platform through which it may offer products, services, experiences, programmes, content and other motorsport-related initiatives.

1.3 The products, services, experiences, programmes, events, promotions and other activities made available through the Website may change from time to time. Particular products, services, programmes, experiences, events, promotions or other activities may be subject to Additional Terms.

2. Definitions and Interpretation

2.1 In these Terms:

“Additional Terms” means any additional or specialist terms, conditions, rules, booking documents or other contractual provisions applying to a particular Product, service, programme, experience, event, promotion or other activity and made available before or at the relevant time.

“Motorsport Dreams”, “we”, “us” or “our” means the legal company identified in Clause 1.

“Product” means a physical product or item of merchandise offered for purchase through the Website.

“Terms” means these General Website Terms together with any Additional Terms expressly applicable to the relevant transaction or activity.

“Website” means the Motorsport Dreams website and any online pages, storefronts, forms and functionality operated by or on behalf of Motorsport Dreams.

“you” or “your” means the person accessing or using the Website or entering into a transaction or arrangement under these Terms.

2.2 Unless the context requires otherwise:

2.2.1 words in the singular include the plural and vice versa;

2.2.4 references to legislation include that legislation as amended, extended, replaced or re-enacted from time to time; and

2.2.5 headings are for convenience only and do not affect interpretation.

3. Scope and Application

3.1 These Terms govern your access to and use of the Website and, where applicable, your purchase of Products through the Website.

3.2 Additional Terms may apply to particular Products, services, programmes, experiences, events, promotions or other activities. Where expressly stated to apply, those Additional Terms form part of the agreement between you and Motorsport Dreams in relation to the relevant matter.

3.3 Where Additional Terms expressly apply and there is an inconsistency between those Additional Terms and these Terms, the Additional Terms prevail to the extent of the inconsistency in relation to the relevant matter.

3.4 Nothing in these Terms requires Motorsport Dreams to offer or continue any particular Product, service, experience, programme, event, promotion or other activity unless expressly agreed in a written agreement.

4. Acceptance of Terms

4.1 By accessing or using the Website, you agree to comply with these Terms to the extent applicable to your use of the Website. Where you enter into a transaction or other contractual arrangement with Motorsport Dreams, the relevant contract will be formed in accordance with these Terms and any applicable Additional Terms.

4.2 By placing an order, application, booking or other transaction through the Website, you agree to these Terms and any Additional Terms expressly applicable to that transaction or activity.

4.3 If you do not agree to these Terms, you must not use the Website.

4.4 If you access or use the Website or enter into a transaction on behalf of another person or entity, you represent that you have authority to do so and to bind that person or entity to the extent applicable.

4.5 You are responsible for using the Website lawfully and legitimately and in accordance with these Terms and any applicable Additional Terms.

5. Use and Purpose of Website

5.1 The Website is provided for lawful purposes connected with accessing information about Motorsport Dreams, Products, activities and initiatives, using Website features, purchasing Products, and submitting enquiries, applications, registrations or other requests.

5.2 You must use the Website responsibly and in accordance with these Terms and any applicable Additional Terms.

5.3 You must not:

5.3.1 use the Website for any unlawful, fraudulent, deceptive or malicious purpose;

5.3.2 interfere with, damage or attempt to obtain unauthorised access to the Website, its systems or networks, or any account or information belonging to another person;

5.3.3 introduce or transmit viruses, malware or other harmful code, or otherwise compromise the security or integrity of the Website;

5.3.4 use bots, automated systems, scraping tools, data-mining techniques or similar means to access, monitor, collect or extract information from the Website except where expressly authorised or otherwise permitted by law;

5.3.5 reproduce, extract, systematically copy, republish, distribute or commercially exploit substantial parts of the Website or its materials except as expressly permitted by these Terms, Additional Terms or law; or

5.3.6 use the Website in any manner reasonably likely to damage the Website, its users, Motorsport Dreams, its reputation or its legitimate interests.

5.4 Motorsport Dreams may restrict, suspend or terminate access to the Website or particular functionality where reasonably necessary in response to breach of these Terms, misuse, security concerns, suspected unlawful or fraudulent activity, or other circumstances affecting the Website or Motorsport Dreams' legitimate interests.

5.5 Nothing in this Clause 5 excludes or limits any rights or protections that cannot lawfully be excluded or limited.

5.6 Any attempt to undermine, duplicate, or exploit the platform, its users, systems, or commercial model for personal or third-party benefit will be treated as a breach of these terms and will result in legal action, financial penalties, and permanent account suspension.

6. Accounts

6.1 Certain Website features may require you to create or maintain an account or provide information.

6.2 You must provide information that is accurate, complete and reasonably up to date.

6.3 You are responsible for keeping account credentials secure and confidential.

6.9 Some Website features may be available without an account, and Motorsport Dreams may change, restrict or discontinue account-based functionality from time to time.

7. Products and Merchandise

7.1 Motorsport Dreams may offer physical products and merchandise including branded apparel, accessories, motorsport equipment and other Products.

7.2 Product descriptions, specifications, dimensions, colours, images and other information are intended to describe or represent the relevant Product. Reasonable non-material variations in colour, appearance, packaging, presentation or other characteristics may occur, including as a result of display settings, manufacturing or availability.

7.3 Product availability, sizes, colours, specifications, quantities and options are subject to availability. Applicable fulfilment or estimated delivery information may vary and may be stated on the relevant Product page, at checkout, in an order confirmation or otherwise.

7.4 Products may be offered on a pre-order or future-availability basis. The relevant Product page or checkout may identify an expected or estimated fulfilment or availability period. Unless expressly stated otherwise, such dates or periods are estimates.

7.5 If Motorsport Dreams is unable to fulfil a pre-order, or if fulfilment is materially delayed beyond the applicable agreed period, Motorsport Dreams will take reasonable steps to notify you and address the position, including providing any cancellation or refund rights required by applicable law.

7.6 Motorsport Dreams may withdraw, modify, replace or discontinue Products and may change specifications, packaging or availability from time to time. Accepted orders will not be affected by such changes except as permitted by the applicable Terms, contract or law.

7.7 Products may be supplied with instructions, warnings, safety information or information concerning intended use. You should use, store and maintain Products in accordance with such information. Nothing in these Terms limits any statutory rights or responsibilities concerning product safety, quality, conformity or legality.

7.8 Where a Product is supplied with a manufacturer's warranty or other express commercial warranty, that warranty is subject to its applicable terms and is additional to any statutory rights you may have.

7.9 Motorsport Dreams may take reasonable safety, recall or regulatory measures in relation to Products, including suspending sales, contacting customers, withdrawing Products or arranging an appropriate remedy where required or reasonably necessary.

7.10 Motorsport Dreams may deliver Products to selected countries or territories. Available destinations, delivery methods and related charges may vary or be restricted for legal, regulatory, operational or commercial reasons.

8. Orders and Contract Formation

8.1 An order submitted through the Website constitutes an offer by you to purchase the relevant Product on the applicable terms.

8.2 Submission of an order, automated acknowledgement or payment authorisation does not necessarily constitute acceptance of the order unless the relevant communication expressly confirms acceptance.

8.3 A contract for the purchase of a Product is formed when Motorsport Dreams communicates acceptance of your order. Under the ordinary ordering process, an automated order confirmation following successful submission may constitute acceptance unless that communication states otherwise.

8.4 Motorsport Dreams may decline or cancel an order before acceptance where, for example, the Product is unavailable, there is an obvious pricing, description or technical error, fraudulent or unauthorised activity is reasonably suspected, or Motorsport Dreams is unable to fulfil the order because of circumstances beyond its reasonable control.

8.5 If an order is cancelled before acceptance after payment has been taken or authorised, Motorsport Dreams will refund the amount actually paid in accordance with applicable law and the circumstances of the cancellation.

8.6 You are responsible for reviewing your order before submission and for providing accurate delivery, billing and contact information.

8.7 Motorsport Dreams may carry out reasonable verification or investigation relating to suspected fraud, unauthorised payment activity, security concerns or other material irregularities and may delay, restrict or cancel an affected order where reasonably necessary.

8.8 An accepted order confirmation may constitute confirmation of the contract and may provide relevant order information in a durable form, including electronically where appropriate.

9. Prices and Payments

9.1 The price payable for a Product is the price displayed at the time the order is placed, except in the case of an obvious error.

9.2 Applicable taxes, delivery charges and other mandatory or additional charges will be identified at checkout or before the order is placed where required.

9.3 Depending on the destination and Product, international orders may be subject to customs duties, import taxes, clearance charges or other destination-specific costs. Where applicable, their treatment will be identified at checkout or otherwise before purchase where required.

9.7 Motorsport Dreams may correct obvious pricing, description or technical errors and, before acceptance, may decline or cancel an affected order.

9.8 If an obvious error is identified after acceptance, Motorsport Dreams may address the position in accordance with applicable law, including contacting you or cancelling and refunding the order where permitted or required.

9.9 Changes to Product prices will not affect accepted orders except where permitted by applicable law or the relevant agreement.

10. Delivery, Returns and Consumer Rights

10.1 Available delivery methods, estimated delivery periods and delivery charges will be communicated through the Website, checkout, relevant Product page or order confirmation and may vary according to the Product, destination and fulfilment arrangements.

10.2 Motorsport Dreams will use reasonable efforts to fulfil and deliver orders within any stated or agreed period. Where no other period has been agreed, applicable statutory delivery requirements will apply.

10.3 Where delivery fails because of inaccurate or incomplete information supplied by you, failure to accept or collect the Product, or another circumstance for which you are reasonably responsible, Motorsport Dreams may take reasonable steps to arrange redelivery or return and may charge reasonable additional delivery or handling costs where permitted by law.

10.4 International customs, import, clearance or similar processes may affect delivery times. Where such processes cause delay, Motorsport Dreams will not be responsible for the resulting delay to the extent that applicable law permits, but this does not limit any mandatory delivery rights or remedies.

10.5 Where you have a statutory right to cancel or withdraw from a purchase, you may exercise that right in accordance with applicable law and the information provided in connection with the purchase. Nothing in these Terms limits or excludes any such right.

10.6 Where a Product is returned under a statutory cancellation or withdrawal right, you may handle and inspect the Product only to the extent reasonably necessary to establish its nature, characteristics and functioning. Where permitted by law, Motorsport Dreams may make a lawful deduction from any refund for diminished value resulting from handling beyond what is reasonably necessary.

10.7 Where you are legally responsible for the direct cost of returning a Product following a change-of-mind cancellation or withdrawal, that cost will be borne by you where the applicable information and legal requirements have been satisfied.

10.8 Your statutory rights and remedies in relation to Products that are faulty, defective, unsafe, not as described, not of satisfactory quality, not fit for applicable purpose or otherwise non-conforming are unaffected.

10.9 Where a Product is faulty, defective, unsafe, misdescribed or otherwise non-conforming, any repair, replacement, refund, return or related remedy will be provided in accordance with applicable law, and costs that are required by law to be borne by Motorsport Dreams will not be passed to you contrary to those requirements.

10.10 Where a Product is personalised or made to your specifications, statutory cancellation or withdrawal exceptions may apply to the extent permitted by law and communicated before purchase.

10.11 Refunds will be provided in accordance with applicable law and, where required, to the original payment method unless otherwise agreed or permitted. Where permitted by law, Motorsport Dreams may withhold a refund until the relevant Product has been returned or evidence of its return has been provided.

10.12 Where applicable law permits, a refund following cancellation may be limited to the cost of standard delivery rather than any additional amount paid for a premium delivery service.

10.13 Nothing in these Terms excludes or limits any mandatory consumer rights or remedies.

10.14 Particular Products, promotions or orders may be subject to additional terms or conditions, but those terms cannot unlawfully limit or exclude mandatory rights.

11. User Content and Submissions

11.1 The Website may allow you to submit, upload, post or otherwise transmit content or materials, including through forms, applications, registrations, reviews, feedback, promotional activities or social features (“User Content”).

11.2 You are responsible for your User Content and must have all rights, permissions and authority necessary to provide it and for Motorsport Dreams to use it as contemplated by these Terms.

11.3 You must not submit User Content that is unlawful, fraudulent, misleading, defamatory, threatening, abusive, discriminatory or otherwise objectionable, infringes intellectual property or privacy rights, contains malicious code, or which you are not entitled to provide.

11.4 You grant Motorsport Dreams a non-exclusive, worldwide, royalty-free licence to use, reproduce, store, adapt, publish, display and distribute your User Content only to the extent reasonably necessary to operate, administer or promote the Website or the particular activity for which the User Content was submitted.

11.5 Where particular media, publicity or content rights are required for a specific programme, event, promotion or other activity, those rights will be governed by applicable Additional Terms or a separate agreement.

11.6 Motorsport Dreams may remove, restrict or decline User Content where it reasonably considers that the content breaches these Terms, applicable law or Motorsport Dreams' legitimate interests.

11.7 Motorsport Dreams is not required to monitor all User Content and, except as required by law, is not responsible for content provided by users.

12. Intellectual Property

12.1 All intellectual property rights in and to the Website and its materials are owned by Motorsport Dreams or licensed to Motorsport Dreams by its licensors.

12.2 Such intellectual property may include the Motorsport Dreams name, trademarks, logos, branding, designs, graphics, photographs, video, audio, written materials, Website design and presentation, original software and functionality, and other original materials.

12.3 Subject to these Terms, you are granted a limited, non-exclusive, non-transferable and revocable right to access and use the Website and its materials for their intended purposes.

12.4 Without prior written permission, you must not:

12.5 Nothing in these Terms transfers ownership of any intellectual property rights to you.

12.6 Specific Products, services, programmes, events, promotions or media activities may be subject to additional intellectual property, licensing, publicity or usage provisions contained in Additional Terms or a separate agreement.

12.7 Nothing in this Clause 12 limits or excludes any rights or exceptions that cannot lawfully be limited or excluded under applicable law.

13.2 Third-party services are operated by their respective providers and may be subject to separate terms, privacy policies and other conditions.

13.4 The inclusion of a link, service, Product or integration does not necessarily constitute an endorsement or recommendation by Motorsport Dreams.

13.5 You are responsible for complying with any applicable third-party terms when using third-party services.

14. Suspension and Termination

14.1 Motorsport Dreams may suspend or restrict access to the Website, an account or particular functionality where reasonably necessary for security, integrity or operation of the Website, to investigate or address fraud, unlawful activity, misuse or unauthorised access, for material breach of these Terms, or for legal or regulatory compliance.

14.2 Motorsport Dreams may terminate an account or discontinue particular Website functionality where reasonably necessary.

14.3 Where practicable and appropriate, Motorsport Dreams may provide notice and an opportunity to remedy a breach before taking action under this Clause.

14.4 Suspension or termination does not affect rights or obligations accrued before the relevant suspension or termination.

15.5 Nothing in this Clause limits or excludes any mandatory statutory rights or protections.

16.3 Nothing in these Terms excludes or limits any liability or legal responsibility that cannot lawfully be excluded or limited.

16.4 Where a specific Product, service, experience, programme, event, promotion or other activity is subject to Additional Terms or a separate written agreement, the applicable liability provisions, risk allocation and remedies will be governed by those terms or that agreement, subject to applicable law.

17.2 Motorsport Dreams may amend these Terms where reasonably necessary for the operation or development of the Website or business, changes in law or regulation, technology, security or operational requirements.

17.4 The version of these Terms in force at the time you access or use the Website will generally apply to that use, subject to Clause 17.5.

19. Governing Law and Jurisdiction

19.1 These Terms and any non-contractual obligations arising out of or in connection with them are governed by the law of England and Wales.

19.2 Subject to Clause 19.3, the courts of England and Wales will have exclusive jurisdiction over disputes arising out of or in connection with these Terms.

19.3 If you are a consumer, you may also rely on any mandatory rights or protections available under the law of your habitual residence and may bring proceedings in any court where applicable law permits you to do so.

19.4 If you are acting in the course of a business, Clause 19.2 applies to the fullest extent permitted by applicable law.

20. Contact and General Provisions

20.2 Severability. If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted and, where necessary, severed. The remaining provisions will continue in effect.

20.3 No Waiver. A failure or delay by Motorsport Dreams to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

20.4 Entire Agreement. These Terms and any Additional Terms expressly applicable to the relevant transaction or activity constitute the agreement between you and Motorsport Dreams in relation to their subject matter, except to the extent a separate written agreement applies or applicable law provides otherwise.

20.5 Assignment. You may not transfer or assign your rights or obligations under these Terms without Motorsport Dreams' prior written consent, except where applicable law does not permit such restriction. Motorsport Dreams may assign or transfer its rights and obligations in connection with a reorganisation, merger, sale of assets, business transfer or other corporate transaction, provided that mandatory consumer rights are not adversely affected.

20.6 No Relationship. Nothing in these Terms creates a partnership, joint venture, agency, employment or fiduciary relationship between you and Motorsport Dreams.

20.7 Third-Party Rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms unless expressly stated otherwise.

20.8 Separate Agreements. Where you enter into a separate written agreement with Motorsport Dreams that expressly covers a subject matter addressed by these Terms, that agreement will govern that subject matter to the extent of any inconsistency, subject to applicable law.

20.9 Electronic Communications. Motorsport Dreams may communicate with you electronically through email, your account, the Website or other appropriate electronic means.

20.10 Survival. Any provision of these Terms which by its nature or express terms is intended to survive the expiry or cessation of these Terms will continue to apply notwithstanding such expiry or cessation.
